01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Lessonira, a brand of The Nelson M Group LLC ("Lessonira," "we," "us"). They govern your use of lessonira.com and related services, for example email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If these Terms are not acceptable to you, do not use the Services.

02What Lessonira is, and is not

Lessonira is an information service. We publish general, plain-language details about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we do not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Lessonira, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

03Eligibility

You need to be 18 or older, located in the United States, and able to form a binding contract before using the Services, and the details you submit must be your own or that of a person who authorized you to submit it.

04Your information and accuracy

You are responsible for supplying accurate, current information and for updating it when it changes. Only a mobile number you own or are authorized to use may be provided. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

Opting in means you agree to hear from us by email and, for the boxes you check, by automated texts as explained in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. • STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-289-1645. Also, please message HELP to any of our numbers to receive help or information about the number.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

You agree not to: (a) submit false, misleading, or someone else's information; (b) use the Services for unlawful, fraudulent, or abusive purposes; (c) interfere with or disrupt the Services or attempt unauthorized access; (d) use bots or automated means to submit forms; (e) copy, scrape, or resell our content without permission; or (f) impersonate any person or entity. We may suspend or end your access if you do.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are run by third parties. We do not endorse any product, plan, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with any doctor or study team is between you and them.

09Intellectual property

The Services, including the Lessonira name, logo, text, graphics, and design, are our property or that of our licensors, and intellectual property laws protect them. The license we grant you to view and use the Services is limited, revocable, non-exclusive, non-transferable, and for personal, non-commercial use. The Site's photographs are used under free-use licenses.

10Disclaimers

We provide the services and all content "as is" and "as available" and disclaim all warranties, express or implied, among them implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or the delivery (or timely delivery) of any message.

Lessonira does not provide financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

Where the law permits, Lessonira and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Some of the limits above might be unenforceable where you live, since some jurisdictions disallow certain limitations. Liability that cannot be limited by law is not limited by these Terms.

12Indemnification

You will indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel for any claims, damages, and expenses, among them reasonable attorneys' fees, resulting from your violation of these Terms, misuse of the Services, or provision of a phone number or other information you were not authorized to give.

13Disputes, governing law, and arbitration

Informal resolution first. Before taking a dispute additional, email us at [email protected] so that we have 30 days to try to resolve it.

Binding arbitration. Except for small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Lessonira or The Nelson M Group LLC arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in your county of residence or by video or phone, at your choice. The arbitrator may award the same individual relief as a court, and judgment can be entered in any court of competent jurisdiction.

Class-action waiver. Both you and Lessonira agree, as far as the law permits, to pursue claims individually only, never as a plaintiff or member of a class, collective, or representative action.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] and state "Arbitration Opt-Out" in the subject line, along with your name and mobile number.

Governing law. These Terms are under the Federal Arbitration Act and to the law of the state of The Nelson M Group LLC's principal place of business, disregarding conflict-of-law rules. Other than as the arbitration clause supplies, courts of that state, state and federal, have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We reserve the right to suspend or terminate access at our discretion, including for violations of these Terms. Disclaimers, limitation of liability, indemnification, disputes, and any other section that by its nature should survive will survive termination.

15Changes

These Terms may change from time to time. Any new version will be posted with a new "Last updated" date, and continuing to use the Services after its effective date means you accept it. Where the law requires notice of material changes, we will give it.

16General

Together with the Privacy Policy and SMS Terms, these Terms are our entire agreement with you on this subject. If a part is held unenforceable, the remainder stays in effect. Not enforcing a provision does not waive it. You cannot assign these Terms without our consent, but we may assign them as part of a merger or sale of the business.
